Hiring a lawyer and understanding contingency fees

A contingency fee ties a lawyer's fee to the outcome of a matter. Georgia's professional-conduct rule requires the agreement to be written and to explain how the fee will be calculated. A directory listing is not that agreement and does not establish the terms a firm would offer for a particular claim.[1]
Questions before representation
The rule requires communication of the scope of representation and the basis or rate of fees and expenses. Useful questions include who will handle the matter and which work the engagement covers. A decision to seek advice may concern a disputed claim or an approaching deadline; no rule makes a directory profile a finding that representation is necessary.[1][2]
Fees and expenses are distinct
A contingent agreement must state the applicable percentage or percentages and explain litigation and other expenses deducted from recovery. It must say whether those expenses are deducted before or after the contingent fee is calculated. The rule requires a written closing statement at the conclusion of a contingent matter. A slogan about fees cannot replace these terms.[1]
Using the firm lookup
These profiles are alphabetical and unranked. They include firms with public car-accident practice material and sourced metro Atlanta office information, using comparable factual fields. The State Bar of Georgia provides a member directory for looking up an individual lawyer. A firm's marketing page should not substitute for checking the relevant attorney's current directory information.[3]
